  1. Found Property
    Abandoned -- Personal property no longer wished to own

    must give up possession;

    • intention to relinquish title
    • and control.

    Lost property -- When you accidentally give up possession w/ no intent to relinquish title and control.
  2. Gifts Can a donor recover gifted property?
    Inter vivos (gift given during life of donor)Donative intent (intent to part with title, not only possession); Must be valid acceptance (silence is usually adequate); Delivery (transfer of possession) Gift becomes final.
  3. Gifts Causa Mortis
    imminent risk of death to donor that is objectivelylikely to occur; gift not valid if donor survives;not valid if donee dies before donor (i.e. donor’s estate retains gift).
