A lawyer cannot represent a person in the ___ legal dispute or a ___ _____ legal dispute who has an adverse interest to her prior client.
S.o.S. -> Same or Substantially Similar
When a dispute is S.o.S (Same or Substantially Similar) how can the conflict be waived
This conflict can only be waived if the former client gives:
1. Consent
2. In writing
Even if the former client agrees to waive the conflict, you still can't use
confidential information you learned in the prior representation to help your new client.
You can't represent someone if the opposing lawyer is your family member unless the clients both give... you guessed it...
informed fucking consent.
What must happen in an aggregrate settlment?
When a lawyer has co plaintiffs in a class action, the lawyer has to tell EVERYONE the total settlement and the dollar amount everyone else got in the settlement.
