  1. Just Cause
    • Employee conduct that amount to a fundamental breech of the employment contract.
    • Serious misconduct
    • Incompetence
    • Willful disobedience
    • Habitual neglect of duty
  2. Progressive Discipline Policy
    A system that follows a sequence of employee discipline from less to more severe punishment
  3. Condonation
    Employer behaviour that indicates to the employee that misconduct is being overlooked.
  4. Conduct Incompatible
    Personal behaviour that is irreconcilable with employment duties or prejudicial to the employers business
  5. Reasonable Notice
    Period of time for an employee to find alternative employment prior to dismissal.
  6. Constructive Dismissal
    Employer conduct that amounts to a breech of a fundamental term of the employment contract.
  7. Wrongful Dismissal Suit Arises when...
    • Employee claims no just cause
    • Employee given notice, but claims notice isn't adequate
    • Can also arise from a constructive dismissal
  8. Grievance Process
    A procedure for resolving disputes contained in union contract.
  9. Seniority
    Usually provide that an employer can not promote, demote, transfer, lay off or recall with out giving some consideration to seniority.
