    A party may be liable for negligence if they owe a duty of due care and breach that duty in which the plaintiff is damaged both actually and proximately caused by the defendant's breach.

    To not create a reasonable risk of harm and act as a reasonable and prudent person would under similar circumstances.
  12. Actual cause
    an factual cause that without its occurrence the the damage would not occur.
  13. Proximate or legal cause
    an event whos occurrence is related to the damage and the court deems is the cause of the damage.

  15. Licensee
    One who enters the property with permission, but not for the purpose the property is maintained.
  16. Invitee
    one who enters the property for the purpose in which it is maintained and confers an economic benefit to the owner.
