Definition of a road
- Any way (other than a waterway) over which there is public right of passage (by whatever means) and whether subject to a toll or not and includes,
- the roads verges and any bridges (whether permanent or temporary) over which,
- or tunnel through which, the road passes and any reference to a road includes parts thereof.
Public road definition under Vehicle Excise and Registration Act 1994

A road which a road authority has a duty to maintain
Motor Vehicle definition

A mechanically propelled vehicle intended or adapted for use on the roads
Driving definition

A person is held to be driving when they have control of the speed and direction of the vehicle
Section 87 Road Traffic Act 1988
Offence for any person
- to drive, or cause or permit another person to drive
- any class of motor vehicle on a road
- otherwise in accordance with a licence authorising them to drive a motor vehicle of that class
Moped definition
motor vehicle that has fewer than 4 wheels and
- was manufactured before 1 Aug 1977
- does not exceed 50cc
- has pedals capable of propelling
or
- was manufactured on or after 1 Aug 1977
- does not exceed 50cc
- max speed does not exceed 30mph
- kerbside weight does not exceed 250kg
Full Moped Licence (6)
- 1/ Minimum age 16
- 2/ Take basic training and gain Certificate of Completion
- 3/ Pass accompanied rider test
- 4/ Disregard L plates
- 5/ Carry pillion passengers
- 6/ Provisional motorcycle/scooter entitlement is given provided 17+ years old
Provisional Moped Licence (4)
1/ Minimum age 16

2/ Basic training and gain Certificate of Completion from Authorised Training body
- Certificate of completion valid for:
- 3 years if obtained before 1 Feb 2001
- 2 years if obtained on or after 1 Feb 2001
3/ L plates

4/ No pillion passengers to be carried
Motorcycle definition

Mechanically propelled vehicle (not invalid carriage) with less than 4 wheels and not exceeding 410kg
Provisional Motorcycle Licence (7)
- 1/ Min 17 yo
- 2/ CBT
- 3/ L Plates
- 4/ No pillion passengers
- 5/ Take & pass full test for full licence within 2 years of issue of provisional
- 6/ 125cc or 11kw with no sidecar
- 7/ Motorcycle with sidecar not exceeding power to weight ratio of 0.16kw per kg
Full Motorcycle Licence (5)
- 1/ Restricted for 2 years to 25kw or power/weight ratio 0.16kw per kg
- 2/ No L plates needed
- 3/ Pillion passengers allowed
- 4/ Full moped entitlement
- 5/ Unrestricted after 2 years
Provisional Car Licences (5)
- 1/ 17 yo
- 2/ L plates
- 2/ No trailer
- 3/ Supervised by 21+ with licence category for 3 years
- 4/ No motorways
Section 164 RTA 1988 - Constable may require a person to produce their driving licence in circumstances: (4)
- 1/ Driving m/v on a road
- 2/ Suspected of having commited a motoring offence
- 3/ Suspected of driving m/v on a road when involved in a road accident
- 4/ Supervising a driver who is a provisional licence holder
Section 103 RTA 1988 - Offence for any person to obtain a licence or drive a m/v on a road whilst disqualified

Power of Arrest

A constable in uniform may arrest without warrant any person driving a m/v on a road who they have reasonable cause to suspect of being disqualified
Section 96 RTA 1988 - offence for any person to drive m/v on a road with uncorrected defective eyesight

A constable having reason to suspect the above may subject person to an eyesight test.
Conditions of eyesight test: (3)
- 1/ Carried out in good daylight
- 2/ Glasses, if worn at time of driving, may be used
- 3/ VRM with letter 79.4mm @ 20.5m
