  1. Definition of an assault:
    An assault occurs when one person intentionally or recklessly, applies force to another person without the others concent.

    An assault could also be when action of a person cause another to fear immediate unlawful violence.
  2. There are 2 types of assault:
    Physical conduct- which is a punch or a kick (battery)

    Threats- causing a person to fear imminent danger
  3. POINTS TO PROVE
    1. Intentionally or recklessly

    2. applies force

    3. to a person

    4. without concent
  4. Intentionally or recklessly.
    Intentionally means doing a deliberate act

    Recklessly means aware that something could happen but does it anyway.
  5. Applied force.
    Applied force can be done directly or indirectly.

    Directly = a kick, punch, throwing something that hits them.

    Indirectly = using an implement, or aiming at one person and hitting another.

    Force does not have to be applied for an assault.

    Fear of violence is enough.
  6. IF A PERSON IS NOT IN FEAR...
    THEN THERE IS NO ASSAULT!!!
  7. Person or another.
    An assault has to be between people.

    i.e. person to person or if a person urges an animal to attack another.
