Evidence is relevant if (a) it has any tendency to make a fact more or less likely and (b) is material.

Relevant evidence may be excluded it its probative value is substantially outweighed by its prejudicial value, confusing the issue, or cumulativeness.

If evidence of a person’s character/character trait is admissible it may be proved (1) by testimony about the person’s reputation or in the form of an opinion and (2) by specific instances of the person’s behavior.

A habit or routine practice may be admitted to prove that on a particular occasion the person or organization acted in accordance with that habit or routine practice.

When measures are taken that would have made an earlier injury less likely to happen, evidence of these measures is not admissible to prove negligence, culpable conduct, a defect in a product, or a need for warning or instruction. This evidence is admissible to prove ownership, control, or the feasibility of precautionary measures.

Offers to pay medical, hospital, or similar expenses are not admissible to prove liability.
