  1. Act:
    A bodily movement , whether voluntary or involuntaryand includes speech.
  2. Actor:
    • 1) A person whose criminal responsablity is in issue in a criminal action.
    • 2) Whenever the term "suspect" is used in this code it means "actor"
  3. Another:
    A person other than the actor
  4. Bodily Injury
    • 1) Physical pain,illness or any impairment pf physical condition
    • 2) Know the diffrences between bodily and serious bodily
  5. Corporation:
    • A) nonprofit corporation
    • B) professional association created pursuant to statue
    • C) joint stock companies
  6. Coercion-Force
    • A)to commit an offense
    • B) to inflict bodliy injury in the future on the person threatened or another
    • C) to accuse a person of any offense
    • D) to expose a person to Hatred, comtempt, ridicul
    • E)to take or withhold as a public servent, or to cause a public servant to take or withhold action
  7. Consent:
    assent in fact, whether express or apparent
  8. deadly weapon:
    1) a fire arm, anything manifestly designed, made or adapted for the puropse of inflicting death or serious bodily injury
  9. Effective Consent:
    • - includes consent by a person legally authorized to act for the owner
    • - Consent is not effective if included by force, threat, or fraud
    • - given by a person the actor knows
  10. Consent:
    • 1) Includes consent by a peson legally authorized to act for the owner
    • 2) consent is not effective if:
    • A) Consent- assent in fact whether expressed or apparent
    • B) Consent- can be wither expredded or implied
    • C) in the criminal consent may be excuess and prevent defendent from liability from what was done
    • D) age, mental disorder
  11. Element of Offense:
    • 1) forbidden conduct
    • 2) required culpability
    • 3) required result
    • 4) negation of any exception to the offense
  12. Harm:
    • 1) anything reasonably regarded as loss, disadvantage
    • 2) injury including harm to another person in whose welfare the person affected if intrested
  13. Institutional Division:
    the institutional division of the Tx department of Criminal Justice
  14. Individual :
    human being who is alive, including an unborn child at every stage of gestation til birth
  15. Law:
    • 1) the constituation or satute of this states of the US
    • 2) A written opnion of a court of record, a municipal ordanice
    • 3) An order of a country commissioners court, or a rule authorized by and lawfully adopted under a statue

  19. Owner:
    • 1) A person who:
    • a- has title to property, possession of the property, whether lawful or not
    • b- a greater right to possession of the property than the actor
    • c- is a holder in due course of a negotiable instument
  20. Peace Officer"
    a person elected, employed, or appointed as a peace officer under the Article 2.12, Code of Criminal Procedure, Section 51.212 or 51.214, Education Code, or other law
  21. Penal institution:
    a place designed by law for confinment of persons arrested for chaged with, or convicted of an offense.
  22. Person:
    an individual corporation
  23. Possession:
    actual care, custody, control, or management
  24. Public Place:
    • 1) any place to which the public or a substantial of the public has access
    • 2) includes but is not limited to streets, highways, and common areas of schools,hospitals apartments, office building
  25. Public Servent:
    a person elected, selected, appointed, employed, or otherwise designated as one of the following, even if he has not yet qualified for office or assumed duties
  26. reasonable belief:
    1) belief that would be held by an ordianary and prudent on or in the same circumstance as the actor
  27. Serious bodily injury-SBI
    • 1) bodily injury that creates a substantial risk of death
    • 2) casues death
    • 3) serious permanent disfigurment
    • 4) protracted loss or impairment of the function of any bodily member or organ
  28. Unlawful:
    • 1) criminal or tortious or both
    • 2) includes what would be criminal or tortious but for a defense not amounting to justification or privilege
  29. Death:
    includes, for an individual who is an unborn child, the failure to be born alive
  30. Habitation:
    • 1) a structure or vechile that is adapted for the over night accomidation of person includes:
    • A) each separately secured or occupied portion of the struture or vechile
    • B) each struture appurtenant to or connected with the struture or vechile
  31. Building:
    any struture or enclosure intended for use or occupation as a habitation or for some person
  32. Property:
    • 1) real property
    • 2) tangible or intangible peronal property, including anything served from land
    • 3) a documnet including money that represents or embodies anything of value
  33. Vechile:
    includes any device in, on or by which any person or property is or may be propelled. moved, or drawn in the normal course of commerce or transportation
  34. Open-Space Land:
    real property that is undeveloped for prupose of human habitation
