Testator has testamentary intent
Testator puts down mark sufficient to be Signature
Two attesting witnesses see him sign
T and witnesses sign within a reasonable time of one
another
What is required to revoke a will?
Intent
Physical act (UPC wants burned or torn etc)
If a third party is going to revoke a will it must be at T's direction and in his conscious presence
Dependent Relative Revocation. What is it?
Allows a revocation of a will to be disregarded which is based on, induced by, premised on a mistake of law or fact if the court is satisied that but for the mistake T never would ahve made the revocation.
